California's New Standards for Fertility Treatment Coverage with SB 729

California's Senate Bill 729, passed in September 2024, introduces new fertility treatment standards, now effective January 1, 2026, following Governor Gavin Newsom’s signing of AB 116. Large Group health plans with 100+ employees must offer infertility and fertility services. These services include three oocyte retrievals and unlimited embryo transfers aligned with ASRM standards. While Large Group plans have to cover these services, Small Group plans only must offer them. The bill also grants the DMHC authority to issue emergency regulations until January 1, 2027.

The bill's non-discrimination clause ensures access to services regardless of age, race, religion, gender, sexual orientation, and other protected characteristics. Additional key aspects include:

  • Definition of infertility and prohibition of exclusions for fertility medications.
  • Protection for third-party reproductive assistance.
  • Exemptions for religious employers.
  • Public employee health plans remain exempt until July 1, 2027.
